Dow Lohnes has a dynamic and aggressive litigation group, with lawyers experienced in all aspects of administrative law, trial work, appellate practice, class action litigation, alternative dispute resolution and litigation counseling.  Our litigators represent college, universities and other postsecondary entities in a wide range of controversies in federal and state courts (both trial and appellate) throughout the United States.  Our lawyers have extensive experience in representing postsecondary clients before the Department of Education, including negotiating settlement agreements, representing institutions in proceedings before administrative tribunals, and pursuing such cases into the Federal courts.  Of note is our experience in qui tam (“whistle blower”) actions, an especially complex and potentially very disruptive process that is increasingly being used against postsecondary institutions, particularly with regard to their use of Federal student aid funds.

Our litigators are also extremely experienced in other areas of law important to our postsecondary clients, such as intellectual property, complex corporate disputes and business torts, securities and SEC matters, commercial law, antitrust matters, tax, trust and estate controversies, white collar and government investigations, libel and First Amendment, government grants and contracting, qui tam actions and labor and employment matters.  Dow Lohnes litigators also have extensive experience with alternative dispute resolution procedures, including formal and informal mediation and arbitration, both in the U.S. and abroad.
