Patent Alert: Federal Circuit panel withdraws ITC appealability issue from prior opinion (GE v. ITC)

(ITC/Procedure) Today, Fri., July 6, 2012, in General Electric v. ITC, No. 2010-1223, the Federal Circuit (Rader, Newman and Linn) granted panel rehearing that reissued its prior opinion without change except that Section III was withdrawn. Section III concerned what constitutes Commission determinations in an ITC investigation that are subject to appeal. The revised opinion basically leaves that issue for some future case.
